The website www.biziker.com (the Website) is the exclusive property of the company Ahoha (limited company registered in the Nantes Trade and Companies Register under number 498400712). The Website is operated by the company Ahoha and gives visitors and members who use the Website (the Internet Users) a certain amount of information regarding the services and memberships to which they can subscribe using the Website itself. The Internet Users who have taken out one of these memberships (the Members) shall have their own Username and Password and their own area dedicated to the use of the services to which they have subscribed.
Use of the Website is on the basis of full agreement to and compliance with the present charter by the Internet User. The Internet User is expected to use the information provided on the Website for personal and non-commercial purposes. Should the Internet User not comply with the provisions of the present Charter, it may be held civilly and/or criminally liable for so doing.
The purpose of the Website is to create a business contacts network. It is aimed very specifically at international business professionals and at individuals who have to travel abroad frequently whilst performing their paid employment.
Ahoha reserves the right to modify the information provided on the Website at any time, in particular should the services provided be changed, without it being able to be held liable for doing so.
The Website constitutes a work of which Ahoha is the “author”, as defined by Articles L111.1 et seq. of the French Intellectual Property Code.
The brand Biziker is a registered trademark for which the company Ahoha has exclusive usage rights. Any and all reproductions, use or affixation of the brand Biziker without the prior consent of the company Ahoha is prohibited, in accordance with the provisions of Article L713-2 of the French Intellectual Property Code.
The data, programs, music samples, text, information, logos, visual identities, images whether animated or otherwise and the layout thereof which appear on the Website are the property of Ahoha and are protected in this respect by the provisions of the French Intellectual Property Code.
All Internet Users undertake to not use them and to not allow anyone whatsoever to use the said content for illegal ends.
Any and all representations or reproductions, in part or in full, on a permanent or temporary basis, entailing the use of computer media and/or of paper, and by any process howsoever (in particular by means of framing*), of any single item on the Website or any single item as regards the services offered thereon for sale, without the prior express consent of Ahoha is prohibited, and constitutes an infringement of copyright law, which may result in judgements against the party so acting in civil and/or criminal proceedings. Solely paper print-outs, for the purpose of private copies for the exclusive use of the person effecting the paper print-outs, as defined by Article L122-5 point 2 of the French Intellectual Property Code, are permitted.
No hypertext links to the Website may be set up without the prior express agreement of Ahoha.
* Framing: the act of capturing the content of website pages and transferring it onto one's own website by means of a hypertext link, making the said content appear to be one's own.
The Internet User may submit certain personal data by completing forms provided thereto. Such data must be entered to enable Ahoha to process the application submitted by the Internet User.
Ahoha undertakes that it shall comply with the provisions of French Act no. 78-17 dated 6th January 1978 on computing, files and freedom, as amended, and shall take all precautions necessary to uphold the security of the personal information in its care. No data of a personal nature shall be provided to third-party companies without the prior, sufficiently-informed, consent of the Internet User.
The Internet User may at any time exercise his or her right to access, correct, delete, and submit an objection regarding the data he or she provided at the time of his or her registration or thereafter, by contacting Ahoha, by means of a letter sent to: Ahoha, 145 boulevard Jules Verne, 44300 Nantes, France, or by means of an email sent to the email address: contact@biziker.com.
Ahoha wishes to place a cookie on the computer of the Internet User. A cookie does not enable the Internet User to be identified. It simply creates a random number which records data regarding the pages on the Website that are visited by the computer and the products placed in the Internet User's shopping basket. Such data is stored for seven days from the time of the order.
The Internet User may prevent cookies from being placed on his or her computer by configuring the settings of his or her Internet browser accordingly. However, a cookie is required if the Internet User wishes to avail of certain services. Thus, if the Internet User selects settings on his or her computer which prevent cookies from being placed on his or her computer, he or she shall note that he or she shall not be able to access certain services
Ahoha shall not be held liable in regard to any malfunctions which may occur on the Website arising in a loss of data or access to data provided thereon not being possible, with the exception of undertakings made to and solely those made to Members.
The items provided on the Website are subject to change without prior notice and are provided to Internet Users without any undertakings of any nature howsoever, either express or tacit, applying to such provision.
The presence of hypertext links which appear on the Website – regardless of whether Ahoha has granted its prior consent therefore – does not create joint and several liability between Ahoha and the owners of the other sites, as to the content of the sites to which the Internet User is redirected.
Ahoha cannot guarantee that the information set out on the Website is either complete or truthful. Similarly, Ahoha cannot provide guarantees that information has not been changed by a third party (by means of intrusions or viruses).
Moreover, the Internet User is solely responsible for his or her use of the content of the Website. Except in cases of serious negligence committed exclusively by Ahoha, Ahoha may not be held liable for direct damages or consequential losses arising out of the use of information set out on the Website.
All of the information circulated on the Website and the use made thereof are governed exclusively by French Law. Solely the courts in the jurisdiction of the Rennes, France, Court of Appeal are competent to hear any disputes regarding use of the Website.
